Section 31(1) of the Act explicitly prohibits any person from commencing or carrying on any food business without a valid license. The Authority holds quasi-judicial powers to inspect, seize, and prosecute non-compliant entities.

Statutory Filing Protocol: Step-by-Step

FoSCoS Identity Creation

The Food Safety Compliance System (FoSCoS) is the unified digital portal. The primary applicant must register using a permanent mobile number and email ID, as these become the unique identifiers for the license's perpetuity.

Legal Caution: Do not use a Consultant's email ID. All OTPs for renewals and query notices will be sent here. Ownership of credentials is critical.

The "Kind of Business" (KoB) Matrix

This is the most litigated step. The applicant must select the KoB that exactly matches operational reality. A single entity may require multiple KoBs (e.g., a Hotel that also sells packaged bakery items at the counter must select both "Hotel" and "Retailer").

Form A/B Filing & E-Signing

Upload all documents (specifically the Water Analysis Report and Layout Plan) in self-attested PDF format. The final submission is not valid until digitally signed.

  • Proprietors: Aadhaar-based E-Sign is sufficient.
  • Companies/LLP: Class 3 Digital Signature Certificate (DSC) of Director is mandatory.

Scrutiny & Query Resolution

The Application moves to the "Bin" of the Designated Officer (DO). If any discrepancy is found, a "Query" is raised on the portal.

Statutory Deadline: All queries must be responded to within 30 days. Non-response leads to auto-rejection with forfeiture of legal fees.

Inspection & Grant

For State/Central licenses, a pre-grant inspection by a Food Safety Officer (FSO) is standard. They verify the layout against the uploaded plan and check for Schedule 4 compliances (Grease traps, Pest control logs). Upon satisfaction, the 14-digit license is generated.

  • Blueprint/Layout Plan: To scale, showing dimensions in meters.
  • List of Directors/Partners: With full address and contact details.
  • Water Analysis Report: Chemical & Bacteriological (NABL Accredited).
  • Landlord NOC: Specifically stating "No Objection to Food Business".

Post-Registration Compliance Obligations

Display Requirements

The 14-digit FSSAI License Number must be displayed prominently at the entrance. "Food Safety Display Boards" (FSDBs) relevant to the business type must be mounted in the workspace.

Annual Returns

Manufacturers and Importers must file Form D-1 annually by 31st May. Late filing attracts a penalty of ₹100 per day.

Hygiene Ratings

Establishments are encouraged to voluntarily opt for "Hygiene Rating". In some municipalities, this is becoming a de-facto enforcement norm.

Liabilities & Penal Consequences

The FSS Act, 2006 imposes strict liability. Violations can lead to both civil penalties and criminal prosecution.

Section 63: Operating Without License

Imprisonment up to 6 months and fine up to ₹5 Lakh.

Section 59: Unsafe Food

If food results in injury: Imprisonment up to 6 years.
If food results in death: Life Imprisonment + ₹10 Lakh fine.

Section 51: Sub-Standard Food

Fine extending to ₹5 Lakh.
